Update on Business Interruption Insurance Matter
Late last year two of the most key aspects of Business Interruption Insurance, related to COVID-19, were decided on in the South African courts in favour of you, the insured.
In thanks:
- We would like to thank our members, and non-members from around the country, for responding, and providing information, when TTA first took up an investigation into this matter in late April 2020 and for continuing to participate and support us throughout the process of gathering information and evidence and building a case against the insurers.
- We would like to thank the advocates and attorneys that we consulted extensively with to guide us on the way forward through each step of the process.
- We would like to thank our Board for initiating contact and meetings with the Financial Services Conduct Authority to escalate and get guidance and feedback on this matter.
- We would like to thank our members who introduced us to claims specialist managers and thank those managers for, together with TTA, building up sufficient awareness and capacity for the support and funding of the test case which, even though it was not a TTA member case that was used at the end of the day. TTA gave this the momentum it needed to go to court.
- To our specialist members in the insurance industry, who gave advice – thank you for your support and expert opinion as well.
- Lastly, but not least, we would like to thank our fellow industry associations who collaborated with us, contributed to the process and ensured that the industry as a whole continued to fight against unfair treatment.
It was a long, protracted, and arduous process but we believe that the result has been worth it for most insured parties, not just insured TTA members, thank you all for staying the course with us!
Despite the above we have received information that some members might still be struggling to get a fair claim pay-out, in a fair time period, from some of the insurers. Should you still be struggling in this regard kindly send the details of your situation to the TTA office on secretary@tshwanetourism.com as we would like to ensure that we finalise this process by assisting anyone who has still not been granted relief.
Kind regards
The Team @ TTA
